"The Constitution has the last word", Hovenier: Draft for the Association, in accordance with the Constitution

The draft statute that has been proposed to Kosovo for the formation of the Association of Municipalities with a Serbian Majority is in accordance with the constitution of Kosovo and fulfills all the criteria provided by the United States.

The guarantee comes from the American ambassador in Pristina, Jeffrey Hovenier, who assures that the draft statute does not provide for executive powers or an additional level of power.

However, according to him, the last word on this draft should be given by the Constitutional Court.

"It must be in accordance with the current Constitution of Kosovo. No constitutional changes should be required. It must be in accordance with the decisions of the Constitutional Court. It should not have executive powers. There should be no additional level of power. We believe that this draft, which has been submitted to the Government of Kosovo, fulfills all these criteria, and we believe that it is written in a way that is in accordance with the Constitution of Kosovo".

All the hysteria regarding constitutionality, according to Hovenier, does not seem appropriate because it was worked very carefully in the drafting. 

Asked why its contents have not yet been made public, the American diplomat clarified that there is nothing secret, and that these are only diplomatic issues for the benefit of the process.

The proposal of Western officials for the formation of the Association of municipalities with a Serbian majority in Kosovo, was presented to the Prime Minister of Kosovo, Albin Kurti and the Serbian President, Aleksandar Vučič, on October 21 by representatives of the United States, the European Union, France, Germany and Italy.
