The preliminary hearing for the Tirana incinerator is postponed, SPAK asked for time to administer some acts. In the hall, all the accused persons were present in relation to this case.
At the end of November, the Constitutional Court did not accept the appeal made for the lifting of the sequestration measure against the Tirana incinerator. Through a decision taken at the Meeting of Judges, the Constitutional Court has assessed not to pass the case for consideration in the plenary session, thus leaving in force the decisions of the three levels of the judiciary on the seizure measure against the company "INTEGRATED ENERGY BV SPV" SH.PK and all its movable and immovable assets, writes A2 CNN.
The sequestration measure requested by SPAK was approved in the Special Court in July of last year and then in the Appeal and the Supreme Court, after suspicions that its de facto shareholders are Klodian Zoto and Mirel Mërtiri.
The Special Prosecutor's Office against Corruption and Organized Crime has sent 12 defendants to trial for "abuse of duty", for the Tirana incinerator.
The list is headed by the former Minister of the Environment, Lefter Koka, to be followed by senior officials of this ministry, the members of the Commission for granting the concession, which also include senior officials of the Municipality of Tirana, as well as two employees of the National Business Center.
SPAK has found violations of the law and government decisions before and during the granting of the concession to Integrated Energy BV SPV with an investment value of over 128 million and 248 thousand euros.
The Commission, Minister Koka and the two senior officials of the Ministry of Environment: legal director Alba Thoma and Procurement Sector Bledar Karoli, have proposed awarding a bonus of 8% of the total points of the competition to the proposing company "Integrated Energy BV" composed of which is also a shareholder of Klodian Zoto's company, "Integrated Technology Services" sh.pk, which was aware of the competitive circumstances before the procedure was announced.
The same group of defendants violated the law since, according to SPAK, the standard concession documents were not drawn up and approved by the commission members when they were uploaded to the Electronic Procurement System.
It turns out that the committee did not hold a meeting or minutes for the drafting of Standard Concession Documents. The documents according to SPAK were drawn up by Klodian Zoto's employees and sent to two officials of the Ministry of Environment, "connecting bridge" with Klodian Zoto's company.
Minister Lefter Koka has approved the continuation of the procedure for granting the concession, without accompanying documentation of the Standard Concession Documents from the Commission.
The law on concessions has been violated by the commission even for the feasibility study, taking without any verification the costs sent by the proposing company, where it turns out that the waste deposit fee from the Local Government Units has been fictitiously increased, 29 Euro/ton.
According to SPAK, if the Concession Granting Commission had calculated the income that the concessionaire company would receive from third parties for the disposal of inert waste, the part that would cover the state budget would be lower.
Regarding the role of the employees of the National Business Center, the Registry of Beneficial Owners, SPAK says that Jetmir Llapaj and Silena Tola have violated the law regarding the registration of the ultimate beneficial owners of the company "Integrated Energy BV SPV".
It turns out that the supporting supporting documentation was not submitted and administered to prove the change of the relevant shareholders for the time period in question. SPAK closes the announcement by saying that the investigations for the Tirana incinerator continue until the responsibility of every person and institution that had a role in benefiting and implementing the contract for the Tirana incinerator, seized nearly a year ago, is revealed.
