Experts are divided in their opinions for and against whether a police officer should be held criminally liable or not, after declaring in the form that he did not use Sky Ecc applications, while SPAK has confirmed the opposite of their statements. Expert Fatjon Softa says that the declaration on the form was false and thus, in addition to the criminal offense proven during the investigations, they should also be investigated for false reporting, writes A2 CNN.
"This type of self-declaration is a false declaration, as long as it proves and comes out, and we currently have arrested suspects who were involved in the dismantling of this application and in communications with unwanted persons. Of course, this is a criminal offense and as such they will be tried and prosecuted for this as well," says expert Fatjon Softa.
Expert Faik Basha describes the self-declaration form as propaganda by the ministry and that police officers cannot be prosecuted for what they signed there, as the form was not legal.
"We had a result of over 11 thousand with 0, which means that it was simply propaganda. The very signing of this statement is not a criminal offense because it is not a law, but it is simply an instruction, and by declaring that you have signed this, you can receive a disciplinary measure. So, we can go as far as a disciplinary measure, up to the most serious one, which could be expulsion from the police, but we cannot be dealing with a criminal offense if this application was used, but it was not used for criminal purposes," says expert Faik Basha.
Basha says that the police and the ministry have no capacity to prove the opposite of the officers' statements. While Softa proposes that police officers should follow the same model as Spak prosecutors so that their mobile phones can be controlled.
"I don't know if we should base it on the law or not, but I think it should be the same model that is for Spak prosecutors, that they allow their phones to be kept under surveillance, but also those of their family circle. Something that can also happen with police officers. First, they should only use the numbers that are dedicated to them, it should be prohibited and all cases of using other phones should be considered a criminal offense or their removal from the police structures," says Softa.
A week ago, on the orders of SPAK, three officers were arrested, including the crime bosses in Lushnje and Himara, and another was declared wanted, after the dismantling of the Sky Ecc applications accused them of collaborating with criminal groups for drug trafficking. (A2 Televizion)
