In the next session on the "Sterilization" case, former Minister of Health, defendant Ilir Beqaj, has requested from the Special Court the recognition as evidence of a 2017 decision to discontinue criminal proceedings against him by the Tirana Prosecution Office, which he qualifies as proof of innocence.
In the Special Court, Beqaj stated that the decision was not made available to him by SPAK, although he had requested it several times, but he later secured it through the Parliament, where the document was sent as part of the materials for the investigative commission.
"I have asked SPAK for a decision several times, but it did not give it to us. We later secured it from the Parliament, which gave it to us, after SPAK had sent it to you among the materials for the investigative commission. It concerns the decision to dismiss a criminal proceeding of the Tirana prosecutor, Endrit Bimi, which for me is a decision of acquittal. I remind the court that one of the government recommendations presented by the Minister of Justice to the General Prosecutor's Office was: 'The rule of law, strict respect for the procedural rights of the defendants is required'", said Beqaj, among other things.
Below is part of the debate:
SPAK Prosecutor, Edvin Kondili: Regarding the request for invalidation of the preliminary court's decision, we request its dismissal, as a request not based on law and evidence.
Regarding the requests for the separation of all defendants from the defendant, Ilir Beqaj, and the summary trial, we consider them fair.
The court, advised in the country, decided to open the judicial review and gave the floor to the prosecution to report the request for the case to be transferred to trial. The prosecutor emphasized that we are familiar with the decision of the judge of the pre-trial session and we request that this case be transferred to the same changes that the judge of the previous session made. Ilir Beqaj, Klodian Rjepaj and Ilir Rrapaj to be tried for "theft by abuse of office and criminal group".
Lawyer Ermal Yzeiraj: I am unclear about the charges, as the prosecution has not specified the charges because verbally they say theft by abuse of office and criminal group, while in writing it is "abuse of office".
They only communicated the first accusation to us.
Beqaj: In the indictment I have, the criminal offense of "abuse of office" is noted. It does not mention "theft" anywhere. There is no figure for theft.
The prosecutor says that the minutes of the indictment session are there. Prosecutor, you never said that. At the session you only said "we accept". (A2 Televizion)
