Single people can also adopt foreign minors in a situation of abandonment. Italy's Constitutional Court declared unconstitutional a part of a 1983 law that prohibited single people from adopting minor children from abroad. In its ruling, the court emphasized that this prohibition could harm the rights of minors, depriving them of the opportunity to live in a stable and harmonious family environment.
The new decision, which amends article 29-bis of law 184/1983, allows single people to adopt foreign children who are in a situation of abandonment, ensuring the possibility of creating a suitable environment for the minor.
The court emphasized that, although the interests of the minor are paramount, the capabilities of the prospective parents must also be assessed, including their emotional capacities and ability to provide education and support for the children.
