Kosovo Supreme Court rejects PDK's appeal on February 9 elections

The Supreme Court of Kosovo on Monday rejected a complaint by the Democratic Party of Kosovo regarding the February 9 parliamentary elections, considering it unfounded.

Officials of this court told Radio Free Europe that they have two more appeals under review, the decision on which "will be made within the legal deadline."

In addition to the PDK, the Vetëvendosje Movement, as well as the coalition between the Democratic Party of Kosovo Ashkali and the Movement for Cooperation, also appealed to this court on March 21.

This, after the Electoral Complaints and Appeals Panel rejected their complaints as unfounded.

From the day of receiving the complaints, the Supreme Court has 96 hours to make a decision.

There are no other complaints to the ECAP - "all have been reviewed," the acting director of the ECAP Secretariat, Tefik Mahmuti, told Radio Free Europe.

What did the parties complain about in the Supreme Court?

The Vetëvendosje Movement demanded that the results of the postal vote for the Democratic League of Kosovo and its candidates be annulled, claiming that there had been “industrial vote theft.”

A candidate for deputy of the Democratic Party of Kosovo from Prizren said that he has received information from three citizens that at a polling station in this municipality, they voted for him, but the candidate received only one vote.

The PDAK-LPB coalition, on the other hand, said it is demanding the cancellation of 211 votes of the Ashkali Party for Integration (PAI), sent by mail, the recount of some votes, and the cancellation of some in municipalities where there are no Ashkali residents at all.

When is the certification of results expected?

If the legal deadlines for addressing complaints are respected, certification of the results by the Central Election Commission should take place this week.

This process would also pave the way for the formation of new institutions, emerging from the elections six weeks ago.

The CEC published the final results on March 15.

According to them, the Vetevendosje Movement - currently in power - secured 42.30% of the votes, the Democratic Party of Kosovo 20.95%, the Democratic League of Kosovo 18.27%, the Alliance for the Future of Kosovo - Initiative coalition 7.06%, while all other parties and coalitions received less.

The results mean that no party has secured enough votes to form a government alone.

With the confirmed results, Vetëvendosje has 48 MPs, and at least 61 are needed to form a majority.

"Currently, the electoral process is in the appeals phase against the final results announced by the CEC on March 15, 2025," CEC spokesperson Valmir Elezi told Radio Free Europe.

"The CEC will await the decisions of the relevant institutions, will implement them if they have obligations for the CEC, and then will be able to proceed with the certification of the final results," he added.

The Vetëvendosje Movement tells REL that, for now, there is nothing concrete regarding talks about any cooperation with any political entity.

Opposition party officials have said since last week that informal talks for cooperation are taking place.
