The Prosecution and the Special Court have held the Ministry of Interior and the General Directorate of the State Police accountable for failing to take security measures during the protest of Erion Veliaj's supporters in front of the court, while the mayor was being sentenced to "prison arrest".
Through a letter addressed to them, SPAK and GJKKO request the administrative or legal liability of the responsible persons in the State Police, who, according to them, have violated the law by not guaranteeing the safety of judges and prosecutors. In the letter that was also made known to the EU Delegation to Albania and the Supreme Court of Justice, the Special Court and SPAK emphasize that the Republic Guard, who are responsible for security within the perimeter of the building, and SPAK itself, after noticing the gathering of people, have requested the police's assistance several times for a cordon of uniformed police officers, but there has been no reaction, writes A2 CNN.
"Based on reports from the Republic Guard employees, repeated requests for assistance have been made to the State Police to guarantee the external perimeter of SPAK and the Special Courts, by establishing a security cordon of police forces. This practice has been followed previously in protests held near the SPAK and Special Courts premises" - SPAK.
SPAK and GJKKO underline that in the evening hours of February 12, protesters prevented judges and prosecutors from leaving the court premises. Even when they attempted to leave, their accompanying vehicles were fired upon by protesters, who cursed and insulted the judges and prosecutors.
"There has been no reaction from its side (the State Police) to cooperate with the Guard of the Republic of Albania, showing an inexplicable indifference in pursuing and preventing this situation, which could seriously endanger the lives and health of judges and administrative personnel. This institutional apathy undoubtedly constitutes a serious violation of the independence of the judiciary. The Special Court of First Instance for Corruption and Organized Crime has considered this unprecedented behavior of the State Police, unacceptable and contrary to the law and by-laws" - GJKKO.
According to the two justice institutions, through inaction, the State Police has obstructed the exercise of their constitutional functions. SPAK and GJKKO have also reminded the State Police that in two other cases of protests in front of SPAK, those of supporters of former Prime Minister Sali Berisha, measures have been taken by the police. In this regard, GJKKO requests the Ministry of Interior and the State Police to make available the entire legal procedure followed and the plan of measures taken in similar cases, such as the two protests held by Berisha's supporters, as well as an argumentative explanation with evidence as to why the same practice was not followed in the case of the incident of 12.02.2025.
