The Special Court has passed the "5D" file for trial. The defendants in this case are Redi Molla, Mariglen Qato, Taulant Tusha, Enton Punavija, Julian Zanaj, Albano Janku and Nestor Muhametllari.
Since the defendants have requested a shortened trial, Judge Elsa Ulliri has requested that the trial panel be expanded with two members. The next hearing is scheduled for 21.02.2024, at 12:00.
On December 26 of last year, the Special Prosecution Office closed the investigations against former directors of the Municipality of Tirana, Redi Molla and Mariglen Qato, and their associates, who are accused of corruption, concealment of assets, and money laundering.
The SPAK file states that, "the defendant Redi Molla in the capacity of the former General Director of the company "Ujësjelles Kanalizime Tirana" sh.a, as well as the defendant Mariglen Qato in the capacity of the former Director of the Support Department in the company "Ujësjelles Kanalizime Tirana" sh.a and the former Chief Inspector of the Inspectorate of Territory Protection in the Municipality of Tirana, were "de facto" owners of the company "5D Konstruksion".
The defendants owned this commercial company indirectly, using other persons as fictitious partners in the company's registration and operation acts, with whom the real partners of the company had social and friendly ties.
SPAK emphasizes that in this file sent for trial alone, they have received 12 tenders, benefiting around 2 million euros in the period 2016-2020. Investigations have revealed that in the period 2016-2018, when Qato held the position of Director of the Support Department at UKT, the company 5D has won 4 tenders, in violation of public procurement rules, from the Municipality of Tirana, "Tirana Parking" and "Tirana Sports Club".
The investigation revealed that the monetary amounts were withdrawn from the banking system using the fictitious invoice payment scheme and were then deposited back in cash in the company's coffers or used by the owners to purchase assets.
