Kleana Xhuveli was only able to be a member of parliament for one week after the Complaints and Sanctions Commission decided that the representation in Parliament of the Albania Initiative coalition belongs to Ana Dajko, who heads the Tirana list. The KAS act surprised even the complaining party itself, which had addressed this body to request the transfer of the mandate from Kleana Xhuveli to Adriatik Lapaj, as the most voted candidate on the open list.
The argument of resignations was considered null and void by the members of the KAS, who, in presenting the decision, took care to underline that this body cannot legitimize an invalid act, and at the same time, the change of the destination of the parliamentary mandate, writes A2 CNN.
"This act does not create any legal consequences because renouncing the candidacy implies in itself the cancellation of the candidacy list of that electoral subject, which has the legal consequence of prohibiting that subject from competing in the elections. For these reasons, the KAS decided to declare the winning candidate from the multi-name list approved by the CEC of the electoral subject, the Albania Initiative Coalition for the Tirana region of Mrs. Ana Kosta Dajko", said KAS member, Elvis Çefa.
According to this decision, for the mandate to pass from the first on the list, which is Ana Dajko, to Adriatik Lapaj, who is 13th, each of the candidates will have to resign individually, after receiving the invitation to take the mandate.
"The act of resignation from candidacy made in this specific case on election day by all candidates on the closed list of the complaining electoral subject, in the sense of the law, is a null act, absolutely invalid, and cannot be taken into consideration. Consequently, the subject cannot claim that the CEC approves a null act," said Çefa.
Under these conditions, the mandate passes from Kleana Xhuveli, known as Lapaj's cousin, to Ana Dajko, known as Lapaj's aunt. If the 60-year-old woman were to step down, the second on the list would be Livia Stavri, known as Endri Shabani's partner.
In addition to the mandate of the Albania Initiative coalition, the KAS also reviewed the appeal request of Andia Ulliri, who claimed Arjan Ndoja's mandate on the DP list of the Durrës district, under the argument of gender quota, but which was rejected. (A2 Televizion)
