Third federal judge blocks President Trump's birthright citizenship order

Another federal judge on Monday blocked President Donald Trump's executive order that ends citizenship for children of people in the United States illegally. He is the third judge to block the order.

The ruling by New Hampshire District Court Judge Joseph N. Laplante follows similar rulings by judges in Seattle and Maryland. The lawsuit, filed by the American Civil Liberties Union, alleges that Mr. Trump's order violates the Constitution and "attempts to undermine one of America's fundamental constitutional values."

President Trump's Republican administration says that the children of those who are not American citizens are not "subject to the jurisdiction" of the United States and therefore do not enjoy the right to citizenship.

The administration has sent the Seattle judge's decision to the appeals court.

At the heart of the lawsuits in all three cases is the 14th Amendment to the Constitution, ratified in 1868 after the Civil War and based on the Supreme Court's decision in the Dred Scott case, which held that Scott, a slave, was not a citizen while living in a state where slavery was outlawed.

In 1898, in the case known as United States v. Wong Kim Ark, the United States Supreme Court ruled that the only children who do not automatically acquire American citizenship upon being born on American soil are the children of diplomats who have pledged allegiance to a foreign country; enemies who are present in the United States during a war situation; those born on foreign ships; and infants of indigenous tribes in America.

The United States is among 30 countries where the right to citizenship is applied in the east. Most of these countries are in Latin America, while Mexico and Canada are also among them. / VOA (A2 Televizion)
