President Vjosa Osmani has addressed the Constitutional Court with a request to review the conflict of constitutional powers created by the lack of constitution of the Assembly of the Republic of Kosovo.
The purpose of the request was said to be to clarify the situation regarding the failure to constitute the Assembly within the 30-day deadline and to clarify how the powers of each constitutional institution are exercised in the absence of the Assembly's constitution.
Given that there are only a few days left before the deadline previously set by the Constitutional Court for the closure of the constitutive session, and that a solution is not in sight, additional clarifications are now required.
"Since every mandatory constitutional deadline and every failure to implement the judgments of the Constitutional Court must also have legal consequences, but they have not been clarified in the preliminary judgment, our request is essentially a request for clarification of the legal consequences of not constituting the Assembly within the constitutional deadline of 30 days," declared President Vjosa Osmani.
Osmani said that this request is made with the aim of preventing irreparable consequences and is in full compliance with the Constitution.
"The request sent to the Constitutional Court does not prejudice the epilogue in extending the remaining four-day deadline for the constitution of the Assembly, so if there is any success in the constitution of the Assembly within a few days, we can withdraw the request, although we believe that the clarity on the issues we have raised in this request is essential not only for this legislature but also for future legislatures," emphasized President Osmani.
The Constitutional Court has been asked to clarify what happens if the Assembly is constituted after July 26, due to the interoperability and dependence that the institutions have on each other.
In order to prevent irreparable damage and protect the public interest, Osmani has asked the Constitutional Court to suspend the 30-day deadline for the constitution of the Assembly.
"Along with this request, we have also submitted a request for a temporary measure to suspend the expiration of the 30-day deadline. A request for a temporary measure is an opportunity to avoid putting institutions in an endless blockade and entering a situation where institutions could be created in an unconstitutional manner and we would be out of luck," said Osmani.
Osmani said that her institution is also failing to fully exercise its constitutional powers due to the absence of the Assembly. (A2 Televizion)
