Arben Ristani, as a lawyer, believes that the security measure "prison arrest" is being misused by justice institutions in Albania.
Ristani, asked on "Off the Record" by moderator Andrea Danglli whether the imprisonment of Erion Veliaj was fair, explained that in the case of the mayor of Tirana, a lighter security measure could have been imposed.
"What I can say and what I want to say is the fact that a bad precedent has been created here, not only with politicians, but also with the citizens of this country, where the measure of prison arrest for me has been misused by exceeding the law. If we refer to the law and the Criminal Code, prison arrest, the law says, is used only when in any other case it is unreasonable to use it," said Ristani on "Off the Record" by Andrea Danglli, on A2 CNN.
According to the former Secretary General of the DP, SPAK and GJKKO must strongly argue the decision to send Veliaj behind bars, but also any ordinary Albanian citizen against whom the measure of "prison arrest" is imposed.
"I do not know the file from the inside and I cannot judge it. I can say that what the public opinion has conveyed are very large and serious problems related to the incinerators. So millions of euros are disappearing and the incinerator does not exist. It is a public fact that several directors of this municipality have been arrested because they stole 100% of the tenders. As a public figure and a politician, it impresses me that a mayor is involved in these affairs and must be held accountable for these scandals. But, I judge that such characters, not only in the case of Mr. Veliaj, because I do not know what the file contains, but the law says that arrest in prison is used when any other measure cannot be used. So there are such elements that we cannot let him go free, because it destroys the evidence, the danger is very great and others... But all of this must be argued.
