The Head of the Special Court, Erion Bani, from the roundtable organized by the Center for Studies and Democracy, chose to address a message to the voices that have criticized the black platoons in the GJKKO for their integrity.
Emphasizing that " the vetting that was done to the judges of the Special Court has not been done to any other judge in the Republic of Albania ," Bani asked critics to address their doubts to the competent bodies.
"Regarding the integrity of judges, as Mr. Dumani said, the Special Courts and the Special Prosecution Office and the BKH as constitutional institutions are the most monitored institutions due to the law and the Constitution. Not only judges, but all family members and all adults are subject to periodic asset controls, monitoring by the General Directorate of Money Laundering, all communications, all messages can be intercepted in real time. Regarding integrity, we must emphasize a fact that international principles and the jurisprudence of the Strasbourg Court, all acts of the Council of Europe have a very important principle that the integrity and credibility of judges are presumed at the moment they are appointed. And judges do not have to prove this, this is presumed, whoever has indications regarding integrity should address them to the competent bodies", said Bani.
Further, the head of the GJKKO underlined that "the judge cannot be tried ." " The judge can only be tried by a higher court. These are the principles and it is good to understand this ," said Bani.
Finally, Judge Bani also listed the filters through which the judges who are part of the body of the institution he heads have passed, as if to show that trust in them should not be questioned.
" Regarding the criteria to become part of the special court, unlike all other citizens, there is a special treatment by the vetting bodies. They treat you with priority and there is a deeper vetting. The moment you pass this filter, you also pass another filter at the Supreme Court of Justice. There is now also a Special Commission at SPAK that guarantees a different filter from all other judges. So you will pass another filter.
