The Special Court adjourns to January 20, at 10:00 a.m., the preliminary hearing of the "Partizani" file. Today's session was interrupted after 4.5 hours due to the end of the official schedule. In a statement to the media, the lawyer Genc Gjokutaj said that during this session Berisha expressed the contentions of a voluminous material, which according to him constitute the lack of criminal fact and for this reason they requested the dismissal of Mr. Berisha's case, reports A2 CNN.
"These were our objections regarding the results of the prosecutor's preliminary investigation. From the morning until now, the contestation of Mr. Berisha ended, an endless page of material, which are simply white papers and we are legally obliged to oppose them and explain why they have nothing to do with Mr. Berisha, they constitute the absence of a criminal fact because we we asked for the dismissal of Mr. Berisha's case. The issue of summary judgment is not discussed as we are looking at a stay and if the court sends the case to trial we will plead not guilty. We will once again explain our innocence even though it is the duty of SPAK to explain the guilt in order to file a charge and defend it in court".
Describing the report on this matter as false, Gjokutaj emphasized that this is done for political and not legal reasons.
"The report on this matter is false. The biography of the property they have claimed that the land has been expropriated, which has been a big lie that we have proven. All contestations and violations and attempts revealing the political profile of this issue that has nothing to do with the law. But it is very voluminous and our disputes were voluminous material to explain in detail why this case cannot go to the court for trial". (A2 Televizion)
