The Tirana Prosecution Office has named Ervin Muça, the former IT director at the State Police, as a defendant. He is accused of unauthorized interference in computer systems, a case related to the copying of data in the TIMS system.
In its announcement, the Tirana Prosecution Office says that "the defendant EM ordered the employees to open the USB ports. The actions were carried out by him until late at night and unauthorized persons entered the building to assist in the back up process, specifically citizen K. M; not part of the staff, he often entered with the personal pin of another employee who was not present."
Also, according to the prosecution, "the connection between the seized hard disk device and the identified computer connected to the servers is clearly proven; the connection was made to enable a manual backup process, by exporting data to the hard disk," A2 writes.

The Prosecutor's Office at the First Instance Court of General Jurisdiction of Tirana has completed the investigations and is sending the defendant EM to trial, currently under the security measure 'House Arrest' for the criminal offense of 'Unauthorized Computer Access' provided for by Article 192/b/2 of the Criminal Code.
From the entirety of the investigative actions for criminal case no. 5404, dated 01.09.2023, it resulted that: the defendant EM, regarding the backup procedures and data extraction, has not informed the General Director of the State Police, there is no information, information memo, action plan for the identified problems and the actions taken to resolve them.

Also, the connection between the seized hard disk device and the identified computer connected to the servers is clearly proven; the connection was made to enable the performance of a manual back up process, by exporting data to the hard disk. A process that does not have to be performed since the system itself automatically makes two back-ups, moreover, traces of the back up process are evidenced on the seized hard disk device. As mentioned above, the unauthorized computer access was achieved. After opening the USB ports, the back up process started, continued, but was not completely completed.
Regarding the criminal offense of "Abuse of office", provided for by Article 248 of the Criminal Code, for which criminal proceedings no. 5404/2023 have also been registered, the case has been decided to be separated.
