SPAK's Dumani in the face of politics: The Assembly's non-binding recommendations were violating independence

The head of SPAK, Altin Dumani, has given a clear message to Albanian politics as he underlined that recommendations sent through the Assembly are not binding on special prosecutors, especially when they are intentionally unclear or biased. During a roundtable discussion dedicated to the balance between SPAK’s independence and reporting, Dumani stressed the need for constructive proposals while preserving the independence of the institutions.

The Head of the Special Prosecution Office, SPAK, Altin Dumani, made it clear to Albanian politicians that none of their recommendations sent through the Assembly affect the purpose or daily work of SPAK, except in cases where they are considered constructive and properly argued. This statement was made during a roundtable dedicated to maintaining the balance between the institution's independence and accountability, organized by the Center for the Study of Democracy and Governance.

"Interventions that are constructive in nature are welcome, but any attempt to violate functional independence through unclear or one-sided recommendations risks unbalancing the constitutional boundaries between the powers. In essence, they do not have a binding role for SPAK, but rather a guiding and supportive one. By respecting the separation of powers and the role of independent institutions, we can maintain the constitutional balance," said Dumani.

The Speaker of the Parliament appeared to raise her hands as she affirmed parliamentary support for the work of SPAK, including in financial terms.

"The Assembly has stood and will stand in support of SPAK, not above it, not before it, but alongside it. The Assembly has approved without hesitation the requests for support with financial, material and human resources for SPAK and other organs of the system, assessing them as priority needs."

The Minister of Justice, Ulsi Manja, while praising the work of SPAK, did not hesitate to assert that accountability should not be seen as a threat.

"Today, more than ever, we need a justice system that is not only independent, but also accountable for its results. This requires transparency, clear ethical and professional standards, and a new institutional culture that sees accountability not as a threat, but as an integral part of its legitimacy."

At the table, the Swedish and EU ambassadors emphasized the need for more progress in justice reform, highly praising the work of SPAK.

Another issue raised in this forum was related to the fate of special prosecutors at the end of their 9-year mandate, an issue for which Dumani requested an official response.
