The wife of the mayor of Tirana, Erion Veliaj, has challenged in the Special Court the court decision of January 14, which allowed SPAK to search an apartment near the "Harabel" center, a search on behalf of the investigation launched against the mayor and his family members.
Sources at the Special Court told A2 CNN that through her lawyers, Ajola Xoxa has filed an appeal against the court's decision, considering it to be in violation of the law. The appeal was filed in the First Instance, while the Special Court's decision "on allowing the control" in point 4 of the enacting clause states that "no appeal is allowed against this decision."
The decision in question allowed a search of apartment number 11/4 in one of the towers in the former block area of the capital, one floor above the offices of "Partnerts Law", a legal consultancy company managed by Veliaj's wife, Ajola Xoxa.
The search of the apartment was requested by prosecutors Altin Dumani and Olsi Dado, following suspicions that it was owned and used by the mayor's family members. The court allowed the search to be carried out with the aim of discovering, administering and seizing evidence related to the criminal offense, including documentary and electronic evidence, electronic devices, mobile phones, laptops or personal computers.
The SPAK investigation against Mayor Veliaj and his family members has been registered for the criminal offenses of "active and passive corruption of high-ranking officials or local elected officials", "money laundering" and "hiding of assets", but there are still no names registered of the persons under investigation.
