During February, the Constitutional Court will review two appeals filed against SPAK seizures on behalf of investigations into former Deputy Prime Minister Arben Ahmetaj and former Prime Minister Sali Berisha.
On February 18, at 10:00, members of the Constitutional Court will consider Arben Ahmetaj's appeal against the seizure of some of his properties and bank accounts, writes A2 CNN.
In a plenary session, which will be held on the basis of documents, i.e. without the presence of Ahmetaj's lawyers, the members of the Constitutional Court will evaluate the claims of the former number two of the government for the annulment of the Special Court's decision of July 2023.
This decision accepted SPAK's request for the seizure of six properties, four apartments and 2 bank accounts, a decision that was later upheld by the Special Appeal and the Supreme Court.
Ahmetaj claims a violation of the Constitution, due to the violation of the right to property and the right to a reasoned judicial decision. The former deputy prime minister asks the constitutional judges to annul these decisions and send the case for retrial to the Special Court.
A week later, on February 25, the Constitutional Court scheduled a hearing to review an appeal filed by Studio Pustina, a law firm that was subject to inspections by SPAK as part of the investigation against former Prime Minister Berisha, where a laptop computer and several paperwork were seized.
In its appeal, Studio Pustina considers the decision of the Special Court and the two higher courts to be unconstitutional and requests their annulment. While the Constitutional Court will filter the relevant decisions of the three judicial courts, Ahmetaj continues to hide from the Albanian justice system, which is currently investigating him in two different files for "corruption", "money laundering", "hiding assets" and "abuse of office".
Meanwhile, the criminal case against former Prime Minister Sali Berisha, accused of "corruption", is undergoing preliminary examination at the Special Court, writes A2 CNN. (A2 Televizion)
