The Special Prosecution Office against Corruption and Organized Crime has filed a request with the Court with the subject matter: “Trial of the criminal case against the defendant Jemin Shera, accused of committing the criminal offenses “Premeditated murder”, committed in collaboration, in the special form of a criminal structural group, “Illegal possession and production of weapons, explosive weapons and ammunition” committed in collaboration, in the special form of a criminal structured group, “Structured criminal group”, and “Commitment of criminal offenses by a criminal organization and a criminal structural group”, provided for in Articles 78/2, 278/1, 333/a/1 and 334 of the Criminal Code”.
2. The trial of this case was conducted under the rules of ordinary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Rudina Palloj, Elsa Ulliri and Etleva Deda, with decision No. 24, dated 12.03.2025, decided:
1. The guilty plea of ​​the defendant Jemin Ali Shera, for committing the criminal offense of "Premeditated Murder", committed for interest, in collaboration, within the framework of a structured criminal group, to the detriment of the victim BS, provided for by articles 78, paragraph 2 in connection with articles 28/4 and 334, paragraph 1 of the Criminal Code, and based on these provisions his sentence to 35 (thirty-five) years of imprisonment. 2. The not guilty plea of ​​the defendant Jemin Ali Shera, accused of committing the criminal offense "Illegal possession and production of weapons, explosives and ammunition", committed in collaboration, in the form of a structured criminal group, provided for by Article 278, paragraph 1 in conjunction with Articles 28/4 and 334, paragraph 1 of the Criminal Code, in reference to Article 388, paragraph 1, letter d) of the Criminal Procedure Code, since it is not proven that he committed the criminal offense for which he is accused. 3. The guilty plea of ​​the defendant Jemin Ali Shera, for committing the criminal offense "Structured criminal group", provided for by Article 333/a, paragraph 1 of the Criminal Code, and based on this provision, his sentence to 4 (four) years of imprisonment. 4. Based on Article 55 of the Criminal Code, in the consolidation of the sentences, the defendant Jemin Ali Shera is sentenced to a single sentence of 35 (thirty-five) years of imprisonment. 5. The calculation of the sentence begins from the day of execution of the decision and the sentence of imprisonment by the defendant Jemin Ali Shera will be served in a high-security prison, in reference to the provisions of Article 16, point 1, of Law No. 81/2020 “On the rights and treatment of persons sentenced to imprisonment and pre-trial detainees”. 6. Based on Article 190, point 1 of the Criminal Procedure Code, the seized material evidence items shall be added to the trial file. 7. The procedural expenses incurred during the preliminary investigations, according to the relevant minutes, as well as the court expenses, according to the relevant minutes, shall be charged to the defendant declared guilty by this decision. 8. An appeal may be filed against the decision to the Special Court of Appeal for Corruption and Organized Crime, within 15 (fifteen) days, starting from the day after the notification of the reasoned decision.
