After 6 months of "house arrest", the mayor of Tropoja is released

The Special Court for Corruption and Organized Crime has decided to release from "house arrest" the mayor of Tropoja Municipality, Rexhë Byberi, and the deputy mayor, Abedin Kërrnaja, who are being investigated on charges of abuse of office and illegal logging.

As an alternative measure, they have been ordered to report to the competent authorities once a month, as according to the lawyers, the 6-month period of the security measure has ended.

Full announcement:

1. The applicant Abedin Kerrnaja on 31.07.2025 submitted to the Court the request
with the subject: “Declaration of the termination of the security measure “House arrest” for the
defendant Abedin Kerrnaja, imposed by decision no. 112, dated 06.09.2024, issued
by the Special Court of First Instance for Corruption and Organized Crime,
ordering the immediate release of the defendant Abedin Kerrnaja”. The applicant
Rexhë Byberi on 31.07.2025 submitted to the Court the request with the subject:
“Request for termination of the security measure”. In the court session on 01.08.2025,
the court decided to merge the aforementioned criminal requests into a single one.
2. At the conclusion of the trial, the Special Court of First Instance for Corruption and
Organized Crime with a panel composed of Judge Irena Gjoka, based on
Articles 112, 228, 229, 234, 237/4, 230, 249, 250, point 1, 261, point 3, 262, 263, point 1,
letter “b”, 266/1 and 466 of the Code of Criminal Procedure, with decision no. 534, dated 01.08.2025, decided:
1. Acceptance of the request of the applicant/defendant Abedin KERRNAJA, with the subject matter
"Declaration of the termination of the security measure "House arrest" for the
defendant Abedin Kerrnaja, imposed by decision no. 112, dated 06.09.2024,
issued by the Special Court of First Instance for Corruption and
Organized Crime, ordering the immediate release of the defendant Abedin
Kerrnaja".
2. Loss of the force of the coercive personal security measure "house arrest",
provided for by article 237 of the Criminal Procedure Code, against the citizen under investigation Abedin
KERRNAJA, imposed by decision No. 112, dated 06.09.2024, of the
Special Court of First Instance for Corruption and Organized Crime, verified
by decision No. 116, dated 12.09.2024, of the same court.
3. Imposition of the coercive personal security measure "obligation to report to
the judicial police", provided for by article 234 of the Criminal Procedure Code, against the citizen under
investigation Abedin KERRNAJA, accused of committing the criminal offense "Abuse
of office", committed in collaboration, provided for by articles 248 and 25 of the Criminal Code.
4. The citizen under investigation, Abedin KERRNAJA, is ordered to appear on the first Monday
of each month, at 11:00, before the judicial police officer AN, at the
Special Prosecution Office against Corruption and Organized Crime.
5. Acceptance of the request of the applicant/defendant Rexhë BYBERI, with the subject
“Request for termination of the security measure”.

6. Loss of the power of the personal security measure “house arrest”,
provided for by article 237 of the Code of Criminal Procedure, against the citizen under investigation Rexhë BYBERI,
assigned by decision No. 112, dated 06.09.2024, of the Special Court of
First Instance for Corruption and Organized Crime, verified by
decision No. 116, dated 12.09.2024, of the same court.
7. Assigning the measure of coercive personal security “obligation to report to
the judicial police”, provided for by article 234 of the Code of Criminal Procedure, against the citizen under
investigation Rexhë BYBERI, accused of committing the criminal offense “Abuse of
office”, committed in collaboration, provided for by articles 248 and 25 of the Criminal Code.
8. The citizen under investigation, Rexhë BYBERI, is ordered to appear on the first Monday of
each month, at 11:00, before the judicial police officer AN, at the
Special Prosecutor's Office against Corruption and Organized Crime.
9. The Special Prosecutor's Office against Corruption and Organized Crime is charged
with executing the court's decision, through the judicial police services at
the State Police Directorate.
10. The parties may appeal this decision within five days at
the Special Court of Appeal for Corruption and Organized Crime. (A2 Televizion)
