The Supreme Court has opened the procedures for applications to replace the president of the Constitutional Court, Holta Zaçaj. According to the Supreme Court, contrary to what Mrs. Zaçaj claims, her mandate ends in March 2025.
In the announcement of the Supreme Court, it is also stated that Mrs. Zaçaj was informed before applying to replace Vitore Tuša in the Constitutional Court, for this term.
A day ago, Zaçaj announced that he has decided to turn to the Venice Commission, as he needs an expert opinion to know when his mandate ends.
"I wish to guarantee public opinion that, in my capacity as President of the Constitutional Court, I will exercise my responsibilities to set the Court in motion in accordance with the opinion of the Venice Commission, which, like the request for amicus curiae, will to be made public. I take the opportunity to bring to attention and ask every other body to respect the independence of constitutional judges, as well as the Constitutional Court itself in exercising the competence to declare the end of the mandate of these judges, announced Zaçaj.
The President of the Constitutional Court explains that she estimates that her mandate ends not now but after 12 months. To put an end to this dilemma and to prevent similar situations in the future, he says he has sought the opinion of international experts.
"The Supreme Court in its decision declared the election of Mrs. Holta Zaçaj as a member of the Constitutional Court with a partial mandate until the renewal in 2025. Given that there is no set date for the end of this task, based on the general legal rules for the calculation of terms, as the final term of exercise of the duty will have to consider the end of 2025", she said.
The Constitutional Court has entered the procedure of its renewal, where in addition to the vacancy created by the resignation of Elsa Toska, the Assembly and the Presidency have started the procedure for the replacement of two other members. (A2 Televizion)
