The chairperson of the Laws Commission and socialist deputy, Klotilda Bushka, reacted after the Venice Commission gave its opinion on the issue of the mandate of legislator Olta Xhaçka, writes A2 CNN.
Bushka said in her speech in a statement to the media, that "Venice" has confirmed the position of the SP that "the Assembly sends for consideration to the GJK the issue of the incompatibility of the mandate of a deputy, only when it is established that the deputy himself uses state assets and benefits of them, while the Assembly examines the other cases itself'.
"The Venice Commission expressed itself on the 5 questions today. I express the highest consideration to the dignitaries of Venice, who read this important matter in record time. This is one more example to underline the role of Venice in strengthening democracy and the principles of the rule of law.
The Venice Commission clearly states that the Parliament is not obliged to vote in a certain way, but is only able to vote within its competence.
Venecia notes that, moreover, the principle that deputies are free to vote according to their beliefs has been confirmed by the Albanian Constitutional Court.
The commission expresses the opinion that the two decisions of the Constitution on Xhaçka's mandate should not have been limited by the vote in the Assembly for their implementation. In a word, the decisions of the CJK should be applicable and should not dictate the vote.
Venecia confirmed the position of the majority that according to the jurisprudence of the Albanian CJK, the Assembly sends for review to the CJK the issue of the incompatibility of the mandate of a member of parliament, only when it is ascertained when we are facing the case of point 3 of article 70 of the Constitution, that is, when the member himself uses assets of the state and benefits from them, while the Assembly examines the other cases itself", said Bushka, writes A2 CNN.
