The Complaints and Sanctions Commission has requested the State Election Commissioner, Ilirjan Celibashi, to initiate criminal proceedings at the prosecutor's office against members of the counting groups of political parties in the districts where the vote recount was conducted.
According to KAS, during this process, significant discrepancies were found between the tables of results approved by the Zonal Electoral Administration Commissions (ZECs) and the actual state of the ballots.
The KAS emphasizes that these discrepancies, in some cases, indicate manipulation of the vote results by members of the counting groups. For this reason, an administrative investigation is required to distinguish whether these are administrative violations or criminal offenses that should be pursued by the justice authorities.
"The recount and re-evaluation of votes in these electoral zones proved in several cases significant discrepancies between the tables of results of the counting groups from the respective CEAZs and the actual state of the ballot papers in the boxes during the recount process in the appeal procedure at the KAS. These discrepancies should be investigated in a further administrative process by your side to identify the members of the Vote Counting Groups. Further administrative investigation for the above-mentioned cases is of particular importance, because referring to the results obtained from the recount in the appeal procedure at the KAS, it results that, in a number of tables of results of the counting and evaluation of votes, the discrepancies of the results approved by the GNVs, with those resulting in the ballot papers, are such that prima facie indicate that there is an alteration of the vote results by the members of the GNVs for special cases", states the KAS request.
In its request to Celibashi, KAS cites the Commissioner's obligation to oversee the activities of the election administration and emphasizes the importance of the investigation for the integrity of the electoral process.
“This administrative investigation is important to identify and distinguish cases that constitute administrative offenses, cases that raise reasonable suspicion based on evidence of the commission of certain criminal offenses in the field of elections from cases that do not constitute grounds for proceeding.”
