Minister of Justice Ulsi Manja presented recommendations for justice in the fight against crime for 2025.
“ Respect for human rights is required, which should be at the center of the work of the Prosecution. Respect for the principle of presumption of innocence, respect for the procedural rights of defendants and victims, avoidance of unjustified delays in investigations and proportional use of security measures are required. Justice institutions are oriented to promote special procedures, especially for minors and cases where the decision can be given with effective alternatives to imprisonment. Strengthening the fight against crime, an increase in initiated investigations and criminal prosecutions for corruption, especially at high levels, and financial investigations for assets of criminal origin are required. International cooperation is required, as well as the fight against cybercrime, integrity, transparency and accountability. The Prosecution must strengthen control beyond the vetting process, every complaint must be treated seriously and transparency for citizens must be increased. The adoption of clear standards for ethics and professionalism is required, as well as the publication of work practices in accordance with the legislation. "Protection of personal data and respect for investigative secrecy ," said Ulsi Manja.
Recommendations, which were criticized by the head of SPAK, Altin Dumani, describing them as unaccompanied by analysis and difficult to implement.
" After being familiar with the recommendations, I cannot help but mention some elements, some of our findings. The recommendations are not accompanied by statistical data, comparative analysis or concrete indicators that justify the need for intervention. This lack makes the recommendations seem subjective and difficult to measure, especially for SPAK, which operates on the basis of efficiency, results and public credibility. The recommendations in some of them use general terms such as proactive investigations, strengthening the strategic approach, but do not offer any operational definition. This creates uncertainty for practical implementation and may lead to different interpretations by the implementing institutions. Some of the recommendations are very general and do not define measurable objectives, responsible institutions or concrete resources, risking remaining unimplementable. I said this to preface them, because at the end of each year we also report on the fulfillment of the recommendations of the Council of Ministers. So, of course, in their entirety, the recommendations are welcome and we express our maximum commitment as an institution to ensure that these recommendations are a priority for the institution's work, but from "On the other hand, some of them, due to the way they are formulated or conceived from a practical point of view, present difficulties in implementation. And I am already finding difficulties in how I will report on the fulfillment of these recommendations ," said Dumani.
Meanwhile, the head of the General Prosecutor's Office asked the government to commit to improving infrastructure, especially in Tirana.
" Important for following up on the recommendations will be especially for the General Jurisdiction Prosecutor's Offices the completion of the staffing. The establishment of special sections and specialized units requires people since we still have 35% of staff shortages, let's say this greatly relativizes the possibility of following up on the recommendations. The second thing I wanted to raise, Mr. Minister, is an issue related to infrastructure, especially with the Tirana Prosecutor's Office and the court of this district, it is an urgent issue. I hope for the continuation of efforts for a solution, since the quality in following up on investigations is also related to ensuring working conditions ," said Çela.
