Accused of corruption, GJKKO sentences Kristi Zyka and Florian Disha to two

The Special Court of First Instance for Corruption and Organized Crime has found guilty, sentencing two defendants to 3 years in prison each, on charges of passive corruption of persons exercising public functions.

Kristi Zyka and Florian Disha were sentenced to three years in prison each, but the sentence was reduced by a third and will ultimately serve two years in prison. According to the decision, they will serve their sentences in a normal security prison.

Likewise, Zyka and Disha are deprived of the right to exercise public functions for a period of 5 years.

The court also ruled that the procedural costs be covered by the defendants. This decision can be appealed to the Special Court of Appeal for Corruption and Organized Crime.

Announcement of the GJKKO 

The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject: "Sending to court the criminal case, pertaining to criminal proceedings no. 8, of 2024, against the defendants Kristi Zyka and Florian Disha, accused of committing the criminal offense "Passive corruption of persons exercising public functions", provided for by Article 259/2 in conjunction with Article 25 of the Criminal Code".

The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Rudina Palloj, Flora Hajredinaj and Bib Ndreca, with decision No. 7, dated 23.01.2025, decided:

The guilty plea of ​​the defendant Kristi Nefail Zyka for committing the criminal offense of "Passive corruption of persons exercising public functions", committed in collaboration, provided for by Article 259, paragraph 2, in conjunction with Article 25 of the Criminal Code and, based on these provisions, his sentence to 3 (three) years of imprisonment.

In application of Article 406/1 of the Code of Criminal Procedure, the defendant Kristi Nefail Zyka's sentence is reduced by 1/3 (one third), being ultimately sentenced to 2 (two) years of imprisonment.

The calculation of the sentence begins from the date of execution of the decision and the prison sentence by the defendant Kristi Nefail Zyka will be served in a regular security prison, in reference to the provisions of Law No. 81/2020 "On the rights and treatment of prisoners and detainees".

Based on Article 35 of the Criminal Code, the defendant Kristi Nefail Zyka is deprived of the right to exercise public functions for a period of 5 (five) years.

The guilty plea of ​​the defendant Florian Eshref Disha for committing the criminal offense of "Passive corruption of persons exercising public functions", committed in collaboration, provided for by Article 259, paragraph 2, in conjunction with Article 25 of the Criminal Code and, based on these provisions, his sentence to 3 (three) years of imprisonment.

In application of Article 406/1 of the Code of Criminal Procedure, the defendant Florian Eshref Disha's sentence is reduced by 1/3 (one third), being ultimately sentenced to 2 (two) years of imprisonment.

The calculation of the sentence begins from the date of execution of the decision and the prison sentence by the defendant Florian Eshref Disha will be served in a regular security prison, in reference to the provisions of Law No. 81/2020 "On the rights and treatment of prisoners and detainees".

Based on Article 35 of the Criminal Code, the defendant Florian Eshref Disha is deprived of the right to exercise public functions for a period of 5 (five) years.

Procedural expenses incurred during preliminary and judicial investigations are borne jointly by the defendants.

An appeal may be filed against this decision at the Special Court of Appeal for Corruption and Organized Crime, within 15 (fifty) days, starting from the day after the notification of the reasoned decision.
