Socialist Party MP Olta Xhaçka and her husband Artan Gaçi have been placed under investigation by SPAK for allegations related to the alienation of properties in Himara. The Special Court has ruled ordering the Special Prosecution Office to register criminal proceedings against MP Olta Xhaçka and her husband Artan Gaçi.
The investigation began after a complaint filed by MEP Fredi Beleri, who requested a review of SPAK's decision not to initiate proceedings against Xhaçka and Gaçi, even though they were related to a similar case involving the former mayor of Himara, Jorgo Goro.
In a decision dated February 28, the Special Court ordered SPAK to register criminal proceedings and continue investigations against MP Xhaçka and her husband for the criminal offenses of abuse of office, falsification of documents, and laundering of the proceeds of crime, committed in collaboration.
The charges relate to the transfer of a property that, according to Beleri, was alienated and then sold to Artan Gaç. This process also included the falsification of documents that gave him an area of 5,512 square meters of land, which was initially registered as a plot of land and then declared agricultural land, for further sale.
Meanwhile, on March 13, the Special Court sentenced Jorgo Goro, the former mayor of Himara, to 3 years and 1 month in prison for abuse of office and failure to declare assets. The sentence was reduced to 2 years and 20 days after the application of a summary trial.
The reasoning of the GJKKO:
"The court finds that the complaint of citizen Dhionisios Alfred Beleri, against citizen Artan Gaçi, for the commission of the criminal offense "forgery of documents", and "laundering of the proceeds of crime" committed in collaboration provided for by articles 186 and 287 of the Criminal Code and Olta Xhaçka, currently Minister of Foreign Affairs, MP, for the commission of the criminal offense "Abuse of office" provided for by article 248 of the Criminal Code, does not have a decision-making, and that the appeal filed by citizen Dhionisios Alfred Beleri. For this part of the complaint, is based on the law. In the specific case, the Special Prosecution Office should register criminal proceedings and continue the investigations on the submissions in the complaint registered with no. 81/2023 that the former Mayor of Himara, Jorgo Goro, the District Council, Vlora and former employees of the ZVRPP, Vlorë in collaboration with each other have committed acts related to the falsification of official documents, which were used to register an immovable property owned by the entity Foto Mehilli and this property was alienated in favor of third parties, specifically the family members of the complainant Olta Xhaçka, and on this property, after it was purchased, the status of strategic investor was obtained by citizen Artan Gaçi, former deputy of the Socialist Party and husband of the complainant Olta Xhaçka, who at the time of taking these decisions by the Council of Ministers, exercised the state duty of Minister of Defense at that time, and the public function of deputy. Citizen Olta Xhaçka, with her inactions, by not declaring the conflict of interest, has benefited through the marital regime property rights and illegal benefits, which according to the law on strategic investors and the law on conflict of interest, do not belong to her.
