The Tirana Prosecution Office and SPAK are playing "ping-pong" with the investigation of a complaint where former Prosecutor General, Adriatik Llalla, is accused of "abuse of office".
The former chief prosecutor sentenced to 2 years in prison by the Special Court for "concealment and failure to declare assets", who never went to prison, after fleeing the country before the sentence, has been reported by a former judicial police officer. The latter claims that Llalla "abused his duty" when he signed an order for immediate dismissal from office in 2016, due to a comment he made on social media.
The Special Court recently considered a request from SPAK to discontinue this investigation, but Special Judge Irena Gjoka found herself in a situation where the file was no longer in SPAK's hands. Under these conditions, Judge Gjoka decided to declare SPAK's request inadmissible, as the trial had become devoid of purpose.
But what happened to the SPAK criminal investigation, no. 103 of 2024. Referring to the decision of the Special Court, provided by A2, initially the report for "abuse of office" against the former chief prosecutor, Adriatik Llalla, was registered by the Tirana Prosecutor's Office in February 2023.
After almost a year of investigation, this prosecution has registered the name of former Chief Prosecutor Llalla as a person under investigation. At the same time, the Tirana Prosecution has declared incompetence and sent the file to SPAK, as the prosecutor who can investigate the allegations against a former Chief Prosecutor.
After taking charge, SPAK registered the criminal case, but at the same time decided to remove Llalla's name from the "abuse of office" charge.
Seven months later, SPAK requested to dismiss the case, a request that was not rejected by the Special Court, which, noting incomplete investigations, returned the file to the prosecution for 3 months. While the court awaited the results of the investigative actions requested by it, on December 30, SPAK declared incompetence, forwarding the file to the Tirana Prosecution Office.
SPAK has assessed that in the case in question they could be faced with the possibility of investigating the criminal offense of "computer fraud". Referring to the decision of the Special Court, the complainant of Llalla has claimed that SPAK did not implement the court's orders and has requested the continuation of the investigation, an investigation that is now in the hands of the capital's prosecutor's office.
