The High Inspector of Justice (ILD) has launched a disciplinary investigation against Judge Antonela Prendi, who serves at the Court of First Instance of General Jurisdiction in Tirana. The investigation was launched following the ILD's inspection report, which analyzed the procedure for announcing and justifying judicial decisions in this court for the period September 1, 2022 - December 30, 2022. During the inspection, it was noted that a number of decisions were submitted after the 120-day deadline provided for by the Code of Civil Procedure, which is considered a reasonable time for submitting reasoned decisions.
After reviewing 21 decisions submitted late by Judge Prendi, the ILD has concluded that the disciplinary violation occurred due to negligence on her part. In some cases, the delays have reached up to two years and four months, while no justifiable reasons have been presented for this delay, such as health or family reasons, other than those related to the workload and capacity of the court.
According to the ILD, the violations are of the nature of a "minor disciplinary violation", considering that the judge has a long and clean career, without previous disciplinary measures, and that she has cooperated during the investigation. As a result, the ILD has proposed the disciplinary measure "Public Reprimand" for Judge Antonela Prendi, according to the legislation in force.
This proposal will be submitted to the High Judicial Council (HJC) for review and final decision-making. (A2 Televizion)
