SPAK demands 4 years in prison for former mayor Fran Frrokaj

The Special Prosecutor's Office has given the claim to the former mayor of Lezha, Fran Frrokaj, and 5 other people, who are accused of the issue of property alienation. SPAK requested 4 years in prison for Frrokaj, a request which, if approved, will be converted to 2 years and 8 months due to the shortened trial.

For the other 5 persons, respectively, 2 years each, with the removal of the right to exercise public functions for 5 years: 2. Sokol Toma (on duty at the time of committing the criminal offense, Director of the Urban Planning Office of Lezhë Municipality) , accused of the criminal offense "Abuse of duty", provided for by article 248 of the Criminal Code, a sentence of 2 years is required.

3. Bledar Cara (on duty at the time of the commission of the criminal offense, lawyer at the Local Real Estate Registration Office, Lezhë), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code, is required to be punished with 2 years.

4. Gjovalin Marku (on duty, at the time of the commission of the criminal offense, sub-employee in Lezhë Municipality), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code, a sentence of 2 years is required.

5. Juxhina Mema (on duty at the time of the commission of the criminal offense, employee in Lezhë Municipality), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code, suspension is required.

6. Adiona Martini (on duty at the time of the commission of the criminal offense, sub-employee in Lezhë Municipality), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code, the suspension is requested.

For Mema and Martini, who were asked to be sentenced to 2 years each, SPAK said that the conditional sentences should be suspended for 5 years.

SPAK also demanded the confiscation of 66 thousand m2 of land in the "Rana e Hedhun" area.

According to the investigations started since 2019, it turns out that 66 thousand square meters of land on the coast of Lezha, worth 13 million euros, were illegally acquired. SPAK argues that it has been documented that large areas were appropriated in violation of the law. Last year, the special court ordered the seizure of these properties. The illegal activity started with the determination of the plot, which is owned by the state, the finding of persons interested in acquiring land, the falsification of ownership documents from the origin of the property to the ownership certificate. According to the prosecution body in this criminal activity, the persons illegally benefiting from the properties included other persons, among them persons close and known to them, fictitiously transferring the assets and then with the final aim to passed into their ownership.

At the end of the investigations, the Special Prosecutor's Office has decided to take 10 people as defendants, some of whom followed the trial by ordinary process, and some others by abbreviated trial.

In addition to the above named defendants, Gjok Ndoka (on duty at the time of the commission of the criminal offense, Chairman of the Lezhë District Council), accused of the criminal offense of "Abuse of duty", provided for by Article 248 of the Criminal Code, was also charged.

Nikolin Shtjefni (on duty at the time of the commission of the criminal offense, Registrar at the Local Real Estate Registration Office, Lezhë), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code. Sokol Vocaj (on duty at the time of the commission of the criminal offense, Registrar at the Local Real Estate Registration Office, Lezhë), accused of the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code.

Luigj Paloka (with the duty of "surveyor" at the time of committing the criminal offense), accused of the criminal offense of "Forgery of documents", provided by article 186/3 of the Criminal Code.

Altin Mikaj (beneficiary of illegally alienated property), accused of the criminal offense "Cleaning the proceeds of a criminal offense or criminal activity", provided for by Article 287, first paragraph, letter "c" of the Criminal Code (A2 Televizion)
