The Special Court has found businessman Namik Koçi guilty and sentenced him to 8 months in prison.

Through a notice, the GJKKO announces that the businessman is accused of committing the criminal offense of "Active corruption of persons exercising public functions".

A2 CNN reports that Namik Koçi offered a sum of money to the director of the AKU, in order to facilitate procedures for testing samples taken from a commercial entity in Durrës.

Announcement of the GJKKO:

The Special Prosecution Office against Corruption and Organized Crime has submitted to the Court the request with the subject: "Sending to court the criminal case, which belongs to criminal proceedings no. 34, of 2024, against the defendant Namik Koçi, accused of committing the criminal offense "Active corruption of persons exercising public functions", provided for by article 244/2 of the Criminal Code".

The trial of this case was conducted under the rules of summary trial. At the end of the trial, the Special Court of First Instance for Corruption and Organized Crime, with a panel composed of judges Flora Hajredinaj, Etleva Deda and Bib Ndreca, with decision No. 28, dated 10.04.2025, decided:

The guilty plea of ​​the defendant Namik Koçi, for the criminal offense of "Active corruption of persons exercising public functions" provided for by Article 244, paragraph two, of the Criminal Code, and his sentence to 1 (one) year of imprisonment.

Based on Article 406, point 1 of the Code of Criminal Procedure, the defendant Namik Koçi's sentence is reduced by 1/3, due to the application of summary judgment, and is ultimately sentenced to 8 (eight) months of imprisonment.

In application of Article 59 of the Criminal Code, the suspension of the execution of the prison sentence is ordered, and the probation of the defendant Namik Koçi is ordered for a probation period of 1 (year) and 4 (four) months, during which the defendant shall not commit another criminal offense, and shall maintain contact with the Probation Service Directorate, which covers his place of residence. The probation period begins after the final decision is made from the moment of the defendant's first contact with the probation service.

Termination of the security measure "obligation to report to the judicial police" under Article 234 of the Code of Criminal Procedure, imposed on the defendant Namik Koçi, by decision no. 18, dated 24.02.2024, of the Special Court of First Instance for Corruption and Organized Crime

Regarding the material evidence: -The amount of 70,000 lek seized during the preliminary investigation, according to the relevant report dated 20.02.2024, shall be confiscated as a tool that served to commit the criminal offense, based on Article 36 of the Criminal Code.

-The amount of 215,000 lek, as well as the iPhone 15 pro max devices, shall be returned to the defendant Namik Koçi.

-The iPhone 13 pro Max device should be returned to citizen V.Ll.

-The iPhone 12 pro Max device should be returned to the HK citizen

-The HDD devices containing the expert reports regarding the examined phones, as well as the USB with the examined materials, shall remain part of the file of this trial.

The procedural costs, those incurred during the preliminary investigation phase in the amount of 9,066.44 (nine thousand sixty-six point forty-four) lekë, and those incurred during the judicial review, according to the form attached to this decision, are charged to the defendant Namik Koçi.

An appeal against this decision is allowed within 15 (fifteen) days, starting from the day after the notification of the reasoned decision, to the Special Court of Appeal for Corruption and Organized Crime. (A2 Televizion)
