The decision on whether former Prime Minister Sali Berisha will be sent as a defendant to the Special Court for the “Partizani” case will be announced by Judge Flojera Davidhi. The Special Court on Monday rejected the request filed by the former Prime Minister accused of “corruption”, his son-in-law, Jamarbër Malltezi and two of their co-defendants to exclude Judge Davidhi from the preliminary hearing.
The decision was given by another special judge, Etleva Deda, who considered the requests for disqualification inadmissible. The rejection of the defendants' request for a change of the preliminary judge means that at the next preliminary hearing of the "Partizani" case scheduled for May 5, Judge Davidhi is expected to withdraw to the consulting room to assess whether she will proceed to trial of the defendants in the case, return the case to SPAK for completion of the investigation, or dismiss it. The request for disqualification of Judge Davidhi was articulated by the lawyers on Thursday, with the claim that the judge had shown bias in the trial.
The core of the lawyers' claim was the judge's interim decision a day earlier, where all of the defense's requests for the invalidity and unusability of certain acts in the file were rejected.
Among the requests, the lawyers requested the invalidation of the financial expertise act, which, according to them, was compiled by BKH agents and not by independent licensed experts.
The preliminary hearing against Berisha, Malltez and six others accused of violating the law during the privatization process of the former "Partizani" sports complex began six months ago in the Special Court. (A2 Televizion)
