After rejection of coalition, LDK sues Kurti and ministers for abuse of power

A few days after refusing to form a governing coalition, the Democratic League on Thursday filed a criminal complaint against incumbent Prime Minister Albin Kurti and his ministers who have been elected MPs.

According to the LDK, Kurti and the 16 members of the government cabinet have been violating Article 26 of the Law on Government since March 27, when the election results were certified, and are committing a criminal offense such as “abuse of official position or authority” sanctioned in the Criminal Code.

Article 26 of the Law on Government states that if a member of the incumbent Government is elected MP, he or she must resign from the position of member of the Government before the day of certification of the election results.

"Since they continue to remain in the offices of the ministries from the date of certification, using resources, making decisions that have financial and other consequences, and using the resources of the institutions of the Republic of Kosovo, these deputies have committed a criminal offense," says Hykmete Bajrami.

Earlier, Kurti had stated that the current cabinet is in a caretaker role, to guarantee the continuity, security and uninterrupted functioning of the state, in accordance with the Constitution and the laws of the Republic. 

Any other action, according to Kurti, would be an abandonment of the institution, would create an institutional vacuum, political irresponsibility and endanger national security. 

But the Democratic League does not agree with this. 

"The country would not be left without a government because it was an option for ministers, if they wanted to continue their work as ministers, to ask not to be certified, or not to be sworn in, and others simply had the opportunity to delegate the task to their deputies because you know that the government in office and the government in resignation, according to the Law on Government, have extremely limited powers," adds Bajrami.

The current government has been in office since March 23, when it has also fulfilled its regular and full four-year mandate. (A2 Televizion)
