The head of SPAK, Altin Dumani, stated that the decisions of the Constitutional Court will be fully respected by the Special Prosecution Office.
"We do not comment on the decisions of the Constitutional Court, we implement and respect them. We do not discuss the decisions of the Constitutional Court. We implement and respect them. We will welcome the reasoning of the Constitutional Court and if we need to express opinions, we will express them," he declared.
Regarding the case of the former director of RTSH, Thoma Gëllçi, Dumani emphasized that during the hearing at the European Court of Human Rights (ECHR), the State Attorney's Office did not request any information from SPAK, thus not giving his institution the opportunity to be represented.
"In the case of the Gëllçi case, there is an institutional lack of coordination. During the review at the ECHR, the State Attorney's Office did not request any information from SPAK, thus not enabling the presentation of our service."
According to Dumani, the Strasbourg court's decision contains inaccuracies, such as the claim that Gëllçi had surrendered himself, while he was located and arrested following a decision in absentia. Also, the deadline for closing the investigation was incorrectly reported, but the essence of the decision was not violated.
"There are inaccuracies in the Strasbourg decision. The ECHR says that Gëllçi was surrendered. Meanwhile, Gëllçi was located after the decision in absentia and arrested. Also, there are inaccuracies regarding the deadline for closing the investigation. Meanwhile, the essence of the decision has not been violated."
Asked why SPAK has not launched an investigation into the State Attorney's Office for this case, Dumani replied:
"For what criminal offense? I had communications with them after we found irregularities."
He emphasized the need for better coordination between institutions.
