The Albanian authorities must identify and punish those responsible for the murder of Aleks Nika, one of the four protesters killed on January 21, 2011 on the "Dëshmorët e Kombit" boulevard.

This is the essence of the decision-making of the European Court of Human Rights in Strasbourg, after examining an appeal made by the widow and daughters of Aleks Nika, whose murder is still an event without a perpetrator identified by Albanian justice.

In Strasbourg, his family claimed that the investigation into him had been ineffective. After examining the case, a body of seven judges of Strasbourg assessed two violations by the Albanian judiciary of the article of the European Convention of Human Rights that speaks of the right to life and to an investigation.

According to Strasburg, the investigation into the murder of Alex Nikas had been ineffective, as it had not determined the truth or led to the identification and punishment of those responsible. The European Court further listed a number of shortcomings in the investigation, which it said suggested that the state authorities had tried to divert the investigation.

The court held the Albanian authorities responsible for the way the authorities used force, or the management of security in the January 21 protest, which resulted in the killing of protesters. Strasbourg highlighted shortcomings in the legal framework that regulated the use of firearms in mass gatherings, as well as a lack of coordination between the Guard and the Police.

" The applicant's relative did not pose any threat to the Guard of the Republic and the Court cannot accept the argument that the defense of a building in itself was a legitimate basis for the use of deadly force ," the decision said.

After the publication of the decision, the former prime minister of the time, Sali Berisha, said that there has never been and could never be an obstacle to the investigation.

" This is the comment I make about everything. How the investigation was done, the files are there, the assessment made by the court. I have no objection ."

For 2 of the 4 killed on January 21, 2021 in the Boulevard, Albanian justice has given a sentence of 1 year in prison for Ndrea Prendi and 3 years in prison for the former guard, Agim Llupo, accused of "manslaughter". (A2 Televizion)
