After 7 months, the Special Court decided this Monday to pass the "Partizani" file for trial, where Sali Berisha and his son-in-law Jamarbër Malltezi are defendants for passive corruption.
After the decision was made by the GJKKO, Berisha's lawyer, Genc Gjokutaj, told the media that the decisions made by Judge Irena Gjoka are invalid, therefore the defense did not request a summary trial.
" All decisions taken by Irena Gjoka are invalid. The court decided to send the case to trial. The court today decided to send the case to trial, while this same judge, under the same conditions in the Dakos case, returned the case for additional investigation without the party's request, while in this specific case she took the case to court. I want to emphasize that this invalidity has kept Mr. Malltezi under "house arrest" for two years. And Mr. Berisha for as long as he was under house arrest, as a result of this illegal decision-making by this judge. Rama, through his agency, the GJKKO, also carried out this phase, to send the case to court. Recently, the Supreme Court has opened a practice contrary to the law that says that the preliminary hearing cannot dismiss the case. Either take it to trial or return it because it is the Basic Court that gives the decision regarding guilt or not. As if we didn't know this. These are the tentacles, the metastases "legal issues that have gripped the Supreme Court and the Constitutional Court. We have not requested a summary trial for two reasons. The first is because there is no criminal fact and we have nothing to shorten or extend. And the second is that the moment we find invalid acts, the summary trial is automatically overturned.
