The Special Court has decided to pass the "Partizani" file for trial, where the accused are the leader of the Democratic Party, Sali Berisha, and his son-in-law, Jamarbër Malltezi.
This decision paves the way for Sali Berisha and his son-in-law, Jamarbër Malltezi, to have their first confrontation with justice.
The former prime minister is facing charges of passive corruption and the security measure "compulsory appearance" is in effect for Berisha.
Meanwhile, his son-in-law faces two charges of passive corruption and money laundering, with Malltez continuing to remain under "house arrest."
Berisha's lawyer, Genc Gjokutaj, told the media that the decisions made by Judge Irena Gjoka are invalid, therefore the defense has not requested a summary trial.
"All decisions taken by Irena Gjoka are invalid. The court decided to send the case to trial. The court today decided to send the case to trial, while this same judge, under the same conditions in the Dakos case, returned the case for additional investigation without the party's request, while in this specific case she took the case to court. I want to emphasize that this invalidity has kept Mr. Malltezi under "house arrest" for two years. And Mr. Berisha for as long as he was under house arrest, as a result of this illegal decision-making by this judge. Rama, through his agency, the GJKKO, also carried out this phase, to send the case to court. Recently, the Supreme Court has opened a practice contrary to the law that says that the preliminary hearing cannot dismiss the case. Either take it to trial or return it because it is the Basic Court that gives the decision regarding guilt or not. As if we didn't know this. These are the tentacles, "The legal metastases that have seized the Supreme Court and the Constitutional Court. We have not requested a summary trial for two reasons. The first is because the criminal fact is missing and we have nothing to shorten or extend. And the second is that the moment we find invalid acts, the summary trial is automatically overturned. This court did this, validated those acts, gave them value and took them to court," said Gjokutaj. (A2 Televizion)
