The Central Election Commission (CEC) does not remove the mandate from the mayor of Kuçova, Kreshnik Hajdari.
The decision was taken today, where in his reasoning, Chief Commissioner Ilirjan Celibashi said that the criminal offense for which Hajdari was convicted (crossing the border illegally in Greece" is not a reason not to be elected or appointed to a public office.
"Article 5 of this law, point 1 is defined, the persons provided for by this law, i.e. subjects subject to the action of this law, must fill out a form where they declare the non-existence of reasons for not being elected or appointed. So the obligation of these subjects is to declare the causes that prevent them from taking a public function, if the causes are missing, there is no obligation for the subject in question to declare anything else that does not constitute a reason to take a public function. Hajdari submitted the declaration form, he did not submit a data related to an administrative criminal process, at a certain time developed in Greece and in his estimation, this was unnecessary or he forgot it is not important in our reasoning, this data is not already certified by the General Prosecutor's Office, it is not included in the conditions of detention due to the criminal offense that made the decision. The discussion remains, due to the fact that he did not declare. Even in compliance with the precedents created by the Institution since 2020 when I am in this position, we have taken the position that the declaring subject is not obliged to present circumstances or reasons that do not prevent him from making the decision," said Celibashi. .
The defense lawyers of "Reestablishment" argued earlier that the mandate should be terminated immediately, since according to them the measure of punishment is not important, but because of the fact that it was not declared in the "Decriminalization" form. However, this attitude of theirs was not taken as a basis.
Kreshnik Hajdari turns out to have been convicted in Greece by the Court of Ioannina in 1999, which he did not declare in the Decriminalization Form. Hajdari was sentenced to 4 months in prison. This sentence was converted to probation for illegal border crossing.
The denunciation of Hajdar was made by the Freedom Party to the State Election Commission in April 2023. Lefter Maliqi, opponent of Kreshnik Hajdar on May 14, has described the non-termination of the mandate as shameful. (A2 Televizion)
