The Council of Ministers has approved the decision on financial compensation for State Police officers whose property is damaged as a result of their duties.
If a police officer's home is attacked with weapons, explosives, or destroyed during an operation, the state can offer him up to 1 million new lek, writes A2.
However, compensation will only be applied if the damage is directly related to the duty and has been subject to criminal prosecution by the prosecutor's office.
Full decision:
The State Police employee, in case of serious damage to property, due to duty, benefits from immediate financial compensation of up to 1,000,000 (one million) lekë, according to the damage assessment acts.
The police employee benefits from immediate financial compensation when:
a) his property has been damaged as a result of a criminal offense, committed to his detriment due to duty, and the case has been referred to the prosecutor's office, or the property has been accidentally damaged during its use by the police employee for the fulfillment of official duties;
b) the police officer has a document that proves the title of ownership/co-ownership over the damaged property, or proves that this property is in the process of being legalized;
c) has not received compensation from an insurance company for property damage.
To receive immediate financial compensation, the employee submits the following documentation:
a) A written request for compensation, stating the fact of the injury;
b) A copy of the letter referring the criminal offense to the prosecutor's office, in the case where the property was damaged as a result of a criminal offense committed to his detriment, due to his duty, and the case was referred to the prosecutor's office;
c) A notarized copy of the document that certifies the title of ownership/co-ownership of the damaged property, or that proves that this property is in the process of being legalized;
ç) Damage assessment report by a licensed expert.
The Director General of the State Police establishes the commission, which consists of 5 (five) members, as follows:
a) Deputy Director General of the State Police;
b) An employee from the Logistics Support Directorate;
c) An employee from the Finance Directorate;
ç) An employee from the Human Resources Department;
d) An employee from the Legal Department.
The Commission shall assess the compliance of the submitted documentation with the criteria for receiving immediate financial compensation, within 10 (ten) working days from the submission of the police officer's request. The Commission shall make the relevant decision available to the Director General of the State Police.
Payment for immediate financial compensation for the damage caused shall be made by order of the Director General of the State Police.
In conjunction with the order mentioned in point 6 of this decision, for the granting of immediate financial compensation, in case of serious damage to property, due to duty, the documentation specified in point 3 of this decision must be found.
In the event that the Commission decides to refuse to grant immediate financial compensation, the employee has the right to appeal the Commission's decision to the Director General of the State Police.
The Director General of the State Police shall decide to accept or reject the employee's appeal. If accepted, the request for immediate financial compensation is returned to the commission for reconsideration.
When the investigation or trial of the case proves that the damage caused was not caused by duty, the police officer who has received immediate financial compensation is obliged to return 100% of the amount received.
Decision No. 169, dated 8.3.2017, of the Council of Ministers, “On the provision of immediate financial assistance to police officers in the event of serious damage to property due to duty”, is repealed.
The financial effects resulting from the implementation of this decision are covered by the State Police budget.
The Ministry of Interior and the General Directorate of the State Police are responsible for the implementation of this decision.
