Freelancers are reimbursed, payments have been made for 90% of them, the process

Freelancers who pre-paid income tax installments have started to get their money back. For those who did not pay their dues before the Constitutional Court abolished their taxation, the Tax Administration has erased the dues by clearing the accounts.

"There are 27 thousand 605 taxpayers who are subject to the Normative Act, and for a part of them, the prepayment plans for the installments generated for the simplified tax on profit or for the tax on profit were cancelled. Whereas for 8,137 taxpayers, the reimbursement procedures should be carried out, i.e. the return of the prepayments they had made to their bank accounts", Rozana Çelmeta, director of the business process at DPT, told A2 CNN.

Although the Normative Act approved by the government at the beginning and in the Parliament then defines December 30 as the deadline, the "taxes" have reimbursed or erased the obligations for 90 percent of the freelancers. 

"For 7,157 taxpayers, for whom a value of 5.75 million euros was sent for payment. Meanwhile, the total liability for all taxpayers who were subject to the Normative Act was 21.6 million euros, of which 15.4 million euros were written off or cancelled," Çelmeta added.

The problem remains a category of taxpayers who do not have an active bank account in Lek in their data in the tax "e-filing" system. However, they do not lose the right to be reimbursed in spite of their luck on December 30. 

"The right to credit the installments that have been prepaid is not lost. The process for those taxpayers that is not completed until December 30 will continue in January from the Regional Directorates, where taxpayers must apply for reimbursement of the amounts paid", stated Çelmeta.

At the end of June 2024, the Constitutional Court overturned several articles of the "Income Tax" law, which provided for the taxation of this category of professionals.

The court assessed that the tax was disproportionate and violated legal certainty. The self-employed tax was approved in March 2023 and provided for a 15 percent tax on incomes up to ALL 14 million, and 23 percent on those who received more. (A2 Televizion)
