The Minister of Justice, Ulsi Manja, has sent the Shkodra prosecutor, Elsa Gjeli, to the ILD.
Disciplinary proceedings have been requested against her for failing to initiate investigations into illegal construction in Theth, writes A2.
In the letter sent to the ILD, it is stated that "The Prosecutor has not analyzed the law "On territorial planning and development", and the requirements for construction permits in protected areas or priority areas for tourism. She has not taken into account that Thethi is a priority area for tourism development and that any intervention in these areas requires a special construction permit and a confirmation act from the KKTU secretariat, even in cases of a preliminary declaration.
By failing to analyze this full legal framework, the prosecutor has replaced the obligation to investigate with an erroneous interpretation of an repealed law, taking on a role that is reserved only for the court.
According to the Ministry of Justice, "this action shows haste and prejudice in the investigation, with a clear tendency not to pursue criminal prosecution, professional incapacity to apply the law in force and above all, exceeding the prosecutor's mission." (A2 Televizion)
