A few hours after a letter from the chair of the constitutive session of the Ninth Legislature of the Assembly of Kosovo, Avni Dehari, arrived at the Presidency, the Head of State Vjosa Osmani reacted regarding yesterday's session, where political forces failed to achieve the constitution of the Assembly.
Osmani has officially responded to Dehar's request, emphasizing that guaranteeing the constitutional functioning of institutions is her essential responsibility as President, therefore she is requesting that the Assembly reconvene within 48 hours.
In the letter to the Assembly, Osmani underlines that the Constitution of the Republic and the judicial practice of the Constitutional Court require an interpretation that enables, rather than hinders, the establishment and constitutional functioning of institutions.
Referring to the Constitutional Court Judgment in Case No. K072/20, the President requests that constitutional structures should be interpreted “in such a way as to implement and not block the functioning of the powers resulting from the vote of the citizens” .
The court, according to Osmani, has clearly emphasized that no constitutional norm can be interpreted in a way that blocks the establishment and effective functioning of legislative and executive power.
Along the same lines, the President also mentioned another Judgment of the Court in case No. K0119/14, which emphasized the obligation of all deputies to find ways to make the Assembly functional, as well as the responsibility of the chair of the constitutive session to fulfill duties in accordance with the Constitution and the Rules of Procedure of the Assembly.
Referring to these principles, Osmani emphasized that the judicial practice of the Constitutional Court now has a binding character, and that it is the responsibility of everyone to contribute to the functionalization of institutions that stem from civic will. (A2 Televizion)
